Definition of Homeless

This definition became effective on January 4, 2012.


Category 1 Literally Homeless An individual or family who lacks a fixed, regular, and adequate nighttime residence, meaning:

i. Living at place not meant for human habitation (car, park, bus, airport);

ii. Living in a shelter, transitional housing and hotels or motels paid for by charitable or government programs; or iii. Individual exiting institution,that that resided there 90 days or less and lived in a shelter or place not meant for human habitation immediately before entering that institution.

Category 2 Imminent Risk of Homelessness

An individual or family who will imminently lose their primary nighttime residence, provided that:

i. Residence lost within 14 days of application;

ii. No subsequent residence identified; and

iii. Lacks resources or support networks needed to obtain housing.


Category 3 Homeless Under Other Federal Statutes

Unaccompanied youth under 25 years of age, or families with children and youth, who do not otherwise qualify under this definition, but who:

i. Are defined as homeless under other federal programs

e.g., Runaway and Homeless Youth Act (RHYA), Head Start Act, Violence Against Women Act (VAWA), Food and Nutrition Act or section 725 of the McKinney-Vento Homeless Assistance Act;

ii. Lived for a long time period without living independently;

iii. Have frequently moved; or

iv. Will continue to experience housing instability because of disability, history of domestic violence or abuse, or multiple barriers to employment.

Category 4 Fleeing/Attempting to Flee DV

Any individual or family who:

i. Is fleeing or is attempting to flee domestic violence, dating violence, sexual assault, stalking or other danger or life-threatening conditions that have either taken place within the primary nighttime residence or has

made them afraid to return to that residence;

ii. Has no other residence; and iii. Lacks the resources or support networks (e.g., family, friends, faith-based) to obtain other permanent housing
